Employee Monitoring and Workplace Privacy Notice

Workplace monitoring only works when it is lawful, disclosed, and limited to a defined scope.

Why this notice exists

Several Netex Security services involve observing employees at work: attendance, procedure compliance, quality assurance, and operational checks. Monitoring of this kind is regulated in most jurisdictions, and doing it badly creates legal exposure for the employer. This notice sets out how we approach it.

What we will not do

  • We do not monitor bathrooms, changing rooms, showers, sleeping areas, or any other area where a person has a reasonable expectation of privacy.
  • We do not conduct covert monitoring of individuals.
  • We do not use facial recognition or biometric identification.
  • We do not monitor employees outside the workplace or outside working time.
  • We do not carry out audio or conversation monitoring unless it is legally permitted, technically supported, properly disclosed, and authorised by the client in writing.

What we do

  • We observe defined activities against procedures the employer has documented.
  • We report factual observations with timestamps and camera references.
  • We report exceptions rather than providing continuous commentary on individuals.
  • We limit observation to areas and hours agreed in the monitoring protocol.

Employer responsibilities

The employer remains responsible for the lawfulness of monitoring at their premises. That normally includes:

  • Having a written employee monitoring policy and making staff aware of it.
  • Providing notice and signage as required in the jurisdiction.
  • Obtaining consent or establishing another lawful basis where required.
  • Consulting employee representatives or works councils where that obligation applies.
  • Completing any impact assessment required by local law.
  • Making all employment, performance, and disciplinary decisions.

Observations are not conclusions

A monitoring observation records what was visible. It is not a finding of misconduct and should not be treated as one. Any investigation, disciplinary process, or decision arising from an observation is the employer's, conducted under the employer's own procedures.

Where we will decline

Netex Security will decline a monitoring request where it would be unlawful, where it targets an individual without a documented and legitimate basis, or where the client is unwilling to disclose monitoring to staff.
